Doctor Kakleas, as a chiropractor and, under Workers Compensation laws, a primary care physician is able to evaluate and treat an injured worker. Many doctors do not treat workers compensation claims as they require a detailed understanding of the laws as well as special and timely documentation of the care procedures. In working with hundreds of work related injuries over 25 years, Dr. Kakleas has come across three important misconceptions about workers compensation:
In answer to the first myth, it is illegal for your employer to punish you for having a work injury or filing a claim. You are entitled by law to receive adequate care to return your health back to how you felt before the injury. Your employer may designate who you see for the first 30 days. If you are not satisfied with the care you have received, you are able to choose another primary care physician, including chiropractors. However, you only get one change of physicians, so choose well.
Regarding the second myth, even if you had pain in an area prior to an injury at work, if the pain increased as a result of a work activity, you are entitled to receive care to return you to how you felt prior to the injury.
And finally in regard to the third myth, many injuries do develop over time. They are now called "repetitive stress" injuries. Examples of this include repetitive computer keyboard use; repetitive bending, lifting, or twisting; and prolonged sitting at a desk. Quite often the symptoms start weeks, or months after the onset of the stress or strain (cause).
